When sickness absence raises legitimate questions

A sickness absence investigation may be appropriate where concrete indications do not appear consistent with agreed arrangements or an employee’s visible conduct. Examples include situations where:

  • the employee carries out work during sickness absence;
  • there are indications of a private business or paid secondary activities;
  • the employee regularly visits other work or business locations;
  • statements about activities, whereabouts or availability are contradictory;
  • visible activities raise questions within the return-to-work process;
  • the employee has stated that medication prevents them from driving but is repeatedly observed driving a vehicle.

A single observation does not always reveal the full picture. Where necessary, we therefore examine conduct and patterns at different times.

What can we establish for you?

Every investigation is tailored to the concrete indications and the question you need answered. Depending on the circumstances, the investigation may include digital research, research into publicly available business activities and targeted surveillance from publicly accessible locations.

We may record:

  • visible work and physical activities;
  • movements and visits to relevant locations;
  • possible work for a private business or third parties;
  • recurring patterns of conduct on different days;
  • publicly available information about business activities;
  • observations with dates, times and locations;
  • supporting photographs or video where lawful and relevant.

This creates a factual and traceable picture of what actually occurred during the investigation period.

Examples from practice

The examples below have been anonymised. The significance of any observations depends on the circumstances of the individual case.

Driving despite a different statement

An employee states that medication prevents them from driving. If the investigation establishes that the employee nevertheless drives repeatedly, we record when, where and how often this occurs. These observations can then be assessed as part of the sickness absence or return-to-work process.

Building work or physical activities

An employee is observed carrying out prolonged renovation, painting or other physical work during sickness absence. We record the nature, duration and frequency of these activities and document relevant patterns objectively.

Operating a business or carrying out secondary work

There are indications that an employee is working for a private business or a third party during sickness absence. Digital research and surveillance may provide insight into visible business activities, work locations and recurring working patterns.

Relevant findings are presented in a clear, dated and traceable report. Observations, times and any supporting images are presented in context so that your HR adviser, occupational physician or employment lawyer can assess the facts.

Dutch Detective Agency records visible and verifiable facts. The medical assessment remains with the occupational physician and the employment-law assessment with your own adviser or lawyer.
